Challenge: Indonesia needs to improve its capacity to draft provincial regulations (Perda). The decentralised governance structure leads to legal coherence problems between national and local law. In addition, Indonesia is facing significant environmental problems such as forest degradation. Legislation on environmental protection needs to be in accordance to international agreements.

The Badan Pengembangan Sumber Daya Manusia (BPSDM) dari Kementrian Hukum dan Hak Asasi (MLHR) the Agency for development of Human Resources in Law and human Rights of the Ministry of Law and Human rights is responsible for providing education for legislative drafters at all levels in the government of Indonesia.
BPSDM has insufficient capacity to deliver good quality legislative drafting training/education. This results in high cancellation of legislation because of deficient or conflicting Perda legislation at local level and an unsatisfied society, whose legal rights are not taken care of adequately because of the current lack of legislation.

Our solution

The overall objective of this project is improved Perda legislation at regional and local level resulting in improved public satisfaction. Well drafted constitutional laws provide effective guidance to national and local governments and contribute to good governance. Focus is on capacity building at BPSDM to increase its performance. We offer BPSDM extensive expertise in the strengthening of institutional, organizational, and individual capacity to develop, update and deliver gender sensitive education and training in legislative drafting responding to the requirements of provincial and national authorities.
